The majority opinion explains, "The Solomon Amendment, 10 U.S.C. §983, requires the United States Department of Defense ('DOD') to deny federal funding to institutions of higher education that prohibit military representatives access to and assistance for recruiting purposes." The court held, "By requiring law schools to help military recruiters 'get [their] message out to students' by distributing newsletters and posting notices, the Solomon Amendment compels law schools to propagate the militarys message...The Solomon Amendment requires law schools to express a message that is incompatible with their educational objectives, and no compelling governmental interest has been shown to deny this freedom."
